The present volume, a tribute to Harry Dondorp, contains contributions to the symposium held on the occasion of his farewell at the Vrije Universiteit Amsterdam. Written by four eminent scholars in the field of legal history, the contributions are related to his areas of interest: delictual liability, Romano-canonical procedure and comparative law texts. The contributors are Wolfgang Ernst, David Ibbetson, Yves Mausen and Andreas Thier. The introductory words are by Eltjo Schrage, Jan Hallebeek and Hylkje de Jong.

We consider the problem of measurement using the Lindblad equation, which allows the introduction of time in the interaction between the measured system and the measurement apparatus. We use analytic results, valid for weak system-environment coupling, obtained for a two-level system in contact with a measurer (Markovian interaction) and a thermal bath (non-Markovian interaction), where the measured observable may or may not commute with the system-environment interaction. Analysing the behavior of the coherence, which tends to a value asymptotically close to (...) zero, we obtain an expression for the time of measurement which depends only on the system-measurer coupling, and which does not depend on whether the observable commutes with the system-bath interaction. The behavior of the coherences in the case of strong system-environment coupling, found numerically, indicates that an increase in this coupling decreases the measurement time, thus allowing our expression to be considered the upper limit for the duration of the process. Multiple -conclusion logic extends formal logic by allowing arguments to have a set of conclusions instead of a single one, the truth lying somewhere among the conclusions if all the premises are true. The extension opens up interesting possibilities based on the symmetry between premises and conclusions, and can also be used to throw fresh light on the conventional logic and its limitations. This is a sustained study of the subject and is certain to stimulate further research. Part I reworks (...) the fundamental ideas of logic to take account of multiple conclusions, and investigates the connections between multiple - and single - conclusion calculi. Part II draws on graph theory to discuss the form and validity of arguments independently of particular logical systems. Part III contrasts the multiple - and the single - conclusion treatment of one and the same subject, using many-valued logic as the example; and Part IV shows how the methods of 'natural deduction' can be matched by direct proofs using multiple conclusions. «A genuine literary treatment of the soul» is what Eugenio Massa called the brief section of Egidio of Viterbo’s Sentences Commentary that he published in 1954. What Massa published is Egidio’s discussion of part of Peter Lombard’s third distinction in Book I, which bears the title «De imagine et similitudine Trinitatis in anima humana». The main topic at so early a place in the Sentences is not, strictly speaking, the human soul but the divine Trinity. The point of departure is (...) Lombard’s consideration of the soul as analogous to the Trinity; and behind that connection lies Augustine, who presented the soul as an image of the Trinity because he saw in the soul a unity and simplicity of substance but also Platonism’s tripartite divisions. These include, for example, the appetitive, emotional, and rational functions, from the Republic, and Augustine’s subdivision of the rational functions into memory, understanding, and will. This connection between Trinity and human soul, however, gave commentators excellent opportunities not only for theology, discourse about God, but also for psychology, the study of the soul. Descriptions of the human soul initially offered in the theological context became important in their own right. According to Massa, in light of the soul’s being created in God’s image, Egidio was able to make human dignity the major theme even at this early point in the commentary. (shrink)

ABSTRACTOne long-running conundrum in Husserlian phenomenology revolves around the question of the identity of what Husserl calls the transcendental ego, a mysterious figure that he identifies as the subject of a genuinely transcendental phenomenology. In dialogue with both Husserl and his assistant and collaborator Eugen Fink, I attempt in this article to give a solid account of the identity of this transcendental ego, and in particular to explain the connection between this figure and the empirical ego of the individual phenomenologist. I make particular reference to Fink's depiction of a "personal union" between these two egos in his Sixth Cartesian Meditation and to certain unclear hints in Husserl's 1923/1924 lectures on First Philosophy. Ultimately, I develop my own account of such a union, which explains the transcendental ego as a certain mode in which the phenomenologist might investigate his own experiences. On this basis, I argue, the status of phenomenology as a transcendental discipline can be understood without subjecting that discipline to certain criticisms that have been levelled against it. On creating a grammar for living together The article is about the question whether it is possible for South Africans to learn a new common moral language. Six well-known positions are considered: a common political language, a common economic language, a common Biblical language, a common Christian language, a common language of survival, and a common rational language.

This article aims at linking empirical research to legal theories, in a way that could enhance the benefits of this synergy. Jurisprudence, until recently the usual term for theoretical approaches to law, is now often replaced by the term legal theory. Difference between legal theory and empirical research is reflected in their consideration of subject matters, aims, and methods of research. However, there also exist commonalities between the two, i.e. both aim at comprehending law and legal systems. While legal theory (...) uses philosophical tools, its subject matter still remains a social phenomenon, for social ends. And since empirical research is a means to gather information about law, it could act as a prime source of information for legal theory. While empirical research has its own end to follow, what is missing is, attention to some legal theory, not just general legal theory, but which can also critique philosophical discourses to legality. The present state of the law is unsatisfactory. The exact effect on the marriage of the parties has not been decided although in English law if artificial insemination by donor (AID) takes place without consent that would appear to be a ground for divorce since 1969. The law regards a child born as a result of AID as illegitimate and draws no distinction between the case where the husband consents and where he does not. Theoretically, an offence is committed if (...) the birth entry is falsified, presumably in cases where the husband consents. The AID child, like any other illegitimate child, has rights against the natural parents, but he is in a worse position than most illegitimate children, in that he may not have any information about his father. It is now possible to freeze sperm and so preserve it over longer periods. All the problems associated with AID are present also when sperm is preserved in banks, but if the law is in an unsatisfactory state in relation to AID this is even more true in relation to sperm banks. The main criticism of the Feversham Report (1960) could be that it recommended, broadly speaking, the `status quo' but scientific progress has now overtaken and left the Feversham findings well behind. What, therefore, is required is a full consideration of the subject of AID and, on the basis of that, some statutory code regulating all its aspects. (shrink)
